Lee Kuan Yew-More Fart from Old Fart

Whatever ones' opinion of Singapore goal keeper, MM Lee Kuan Yew, the latest of latest is one of Islamophobia

Endearing himself to neighbours has not been his forte. His faux pas in the Johor criminals and the marginalised Chinese comments drew another official apology. Justified yellow card offences.

His latest, a red card this time, will not bring him any closer. It will in fact alienate him further not only from his immediate neighbours but the Muslim world as well.
'I would say today, we can integrate all religions and races except Islam," he said in "Lee Kuan Yew: Hard Truths to Keep Singapore Going," a new book containing his typically frank views on the city-state and its future.'

Player manager, Harry Lee, prides himself the father of squeaky clean team Singapore. Is it really? Allegations here and there suggests otherwise.

"Andy Xie's resignation as Morgan Stanley's chief economist in Asia last week followed an e-mail in which he characterized Singapore as an economic failure dependent on illicit money from Indonesia and China"

The DAP (originally the Malaysian branch of the Singapore People's Action Party, PAP) Harry Lee Supporters Club, which sing his praise of "meritocracy" policies, attests to his track record. No wonder they are his fan boys.

Elections looms in Singapore.

GFI-Go For It

It never cease to amaze me how economic analyses, reports and forecasts are taken seriously by anyone.

None more so than the alternative media. Especially if it portrays our country negatively.

As for me, next to lawyers, economists are another profession I view cynically.

The "latest" economic report making the waves is by an organisation GFI, Global Financial Integrity.

Its mission Statement

"Global Financial Integrity (GFI) promotes national and multilateral policies, safeguards, and agreements aimed at curtailing the cross-border flow of illegal money. In putting forward solutions, facilitating strategic partnerships, and conducting groundbreaking research, GFI is leading the way in efforts to curtail illicit financial flows and enhance global development and security."

Wow, "global development and security" but whose only report thus far focuses on "developing countries" in Asia. So much for being global.

What the bloody fuck!

I deign to to delve into the details and technicalities of the report but suffice to submit the following quote for such a grand sounding org.

"Our 2008 report, Illicit Financial Flows from Developing Countries: 2002 – 2006, produced the startling conclusion that some US$1 trillion a year of illegally generated or transferred money is escaping from poorer countries into richer countries.

"Updating the earlier report, we are pleased to present here our analysis Illicit Financial Flows From Developing Countries: 2000 – 2009.

In this report we venture an estimate for 2009, based on incomplete data.”

What the fuck!

By the way, it would be interesting and I implore GFI, to render
an IFF for "developed countries", to give the issue more perspective.

Pariah, Nigger and Shylock

The Interlok affair has been taken out of context and blown completely out of proportion. Despite the author, national laureate Dato' Abdullah Hussein's
explanation, there are still some quarters hyping up the 'pariah' issue.

When you ignore facts, what does that make you?

And since the topic of racism is trendy nowadays among polticians, innocuous matters remotely associated to racism but to get brownie points, would be "exposed" as such.

Politicians have the tendency to spit. They should be careful in which direction they spit.

The spit might just land on their own faces.

Kenny Dalglish-Return of the King

Is buying players, a recipe for success? We can cite examples, for and against, this school of thought. Presently, Real Madrid and Man City come to mind, against this reasoning.

Chelsea has recently been successful in the Premier League. It is debatable, however, whether it was Abramovich's moolah or due to proficient managers. Chelsea won the 2009-2010 Premier League without any significant signings.

Buying of players in conjunction with a competent and able manager, these are prerequisite ingredients for a successful team. But the most important are the OWNERS. It has always been the owners. Astute owners, who are not inclined to interfere, who support the management and coaching of the team.

This is a proven fact of successful teams in the Premiership.

Just look at the Premier League winners since inception in 1992 to the present. There has only been 4 clubs who have won the Premiership. Manchester United, Arsenal, Chelsea and Blackburn Rovers.

Its synonymous these clubs achieve success because managers have the complete backing of the owners. The owners do not at all utter anything bad or act detrimentally to their managers. Never any interference. Its always been one of support.

Chelsea has not still learnt from this, Mourinho and Ray Wilkins, are testimonies for its ups and downs. It is not my purpose to single out Chelsea in bad light but its only because it has everything to do with Liverpool FC.

Liverpool Football Club is of my concern. Hicks and Gillet must be blamed for the failure in that ultimate goal, of winning the Premiership. The owner/manager relationship festered when they undermined Benitez in the Klinsman affair. In spite of this animosity created, Benitez came close, finishing 2nd in the 2008/2009 season.

Benitez had just delivered the European Championship with the previous, true red blooded Liverpool Football Club, owners.

Buying is a mixture of hits and misses that figure in all of these winning clubs. Purchasing right players that fit the team, that too is a similar trait. Cantona/Schmeichel, Vieira/Lehman, Drogba/Cech/Lampard and Shearer/Sutton rings the bell. Wenger has a proven, uncanny knack in this department.

That being said, the wrong ones are too many to state. Taibi anyone?

Most importantly and decisively, it is acquiring players who will commit to the club, willing to work and win as a team. Players who understand and uphold the legacy, tradition and honour of the club. Players who will place club above self.

Manchester United is head over heals, in this doctrine, above the rest. That's why they have won the most Premierships, the scum.

Undeniably, British natives play a crucial and significant role. The likes of Giggs, Robson, Terry, Lampard, Keown, Adams, Shearer et al.

Not mercenaries, which money have now made players to be. And they are plentiful. Agents being prime movers to this mentality.

Erstwhile money made available is important, it does not necessarily translate to immediate success.

No, by itself, buying is not a magic bullet.

Success is the combination in order of importance, first the astute owner, the capable manager and only then, funds. For what good are funds without the artful manager. And what good is a manager, who does not have the complete confidence of the owner.

In all intent and purposes John W. Henry understands and is aware of all this. He has proven so, Stateside.

A gentleman he is. Roy was not appointed by the new owners but was yet given the opportunity and full reins to do the job. The results were less than desirable.

Damn if John Henry did and damn if he didn't take any action. The job was not being done well and before it was too late. Roy's apologists will say that he should have been given time.

But this is not Fulham, this is Liverpool.

Benitez was sacked for ending 7th. More than half the season has gone and 4 points adrift of relegation.

No, this is not Fulham, this is Liverpool.

That's why he called Dalglish.

LFC have players, the right players. Scousers Gerrard and Carragher. Players who will do and give all, for the Club. Reina, Torres (cynics be damned), Kuyt and even Lucas. Among the faithful, there are cries for Xabi to return. Babel, Ngog and others have shown honest commitment when given the chance.

Money, for the moment, is not important but it can help. There are unpolished gems in the team, Kelly and Shelvey, are proof of this.

It is now up to Dalglish to do the needful, to turn around and galvanise the team. On the field or on the bench, its all for the good of the Club.

Lets not kid ourselves, we need the points, at this stage. Thats why he was appointed, at this stage.

Look at the Premiership winners again, 4 clubs and only 5 managers in 18 seasons. United has 11, both Arsenal and Chelsea having 3. The only club that has won only 1 Premiership title is Blackburn Rovers.

To manage a club and become part of the elite must have taken someone special.

The manager of that Blackburn Rovers side was a certain Kenny Dalglish.

The measure of the man's ability will be appraised when Liverpool take on Blackpool, away at Bloomfield Road, today.

For good measure indeed, Liverpool lost to the Tangerines 1-2 in the corresponding fixture, at Anfield, under Roy Hodgson.

Selangor State Secretary

Selangor Mentri Besar Tan Sri Khalid Ibrahim and the Selangor State Government, has not a snowball chance in hell, to enact any law for the appointment of the state secretary.

The appointment was made in line with the Federal Constitution and I cite the relevant articles.

1) The appointment was made by the Chief Secretary of the Public Services Commission (PSC)

2) The PSC Article 139 has jurisdiction to all members of the services Article 132 (1)

3) However, States can have the authority only to regulate the qualifications for appointment and conditions of service. Article 132 (2)

4) The States has the authority to extend the jurisdiction of the PSC and if there is no law to that effect (extending the jurisdiction), then the Federal law applies Article 139 (2)

5) The Chief Secretary is empowered by reading article 139 together with article 144

Article 132 Public Services

(1) For the purposes of this Constitution, the public services are—

(a) the armed forces;

(b) the judicial and legal service;

(c) the general public service of the Federation;

(d) the police force;

(e) (Repealed);

(f) the joint public services mentioned in Article 133;

(g) the public service of each State; and

(h) the education service.

(2) Except as otherwise expressly provided by this Constitution, the qualifications for appointment and conditions of service of persons in the public services other than those mentioned in paragraph (g) of Clause (1) may be regulated by federal law and, subject to the provisions of any such law, by the Yang di-Pertuan Agong; and the qualifications for appointment and conditions of service of persons in the public service of any State may be regulated by State law and, subject to the provisions of any such law, by the Ruler or Yang di- Pertua Negeri of that State.

Article 139 Public Services Commission

(1) There shall be a Public Services Commission, whose jurisdiction shall, subject to Article 144, extend to all persons who are members of the services mentioned in paragraphs (c) and (f) of Clause (1) of Article 132, other than the Auditor General, to members of the public services of the State of Malacca and the State of Penang, and, to the extent provided by Clause (2), to members of the public service of any other State.

(2) The Legislature of any State other than Malacca and Penang may by law extend the jurisdiction of the Public Services Commission to all or any persons in the public service of that State, but no such law shall take effect earlier than twelve months from the date of its passing; and if at any time there is not, in any such State in which no such law
is in force, established and exercising its functions a State Public Service Commission, the jurisdiction of the Public Services Commission shall, if federal law so provides, extend to all members of the public service of that State.

Article 144 Functions of Service Commissions

(1) Subject to the provisions of any existing law and to the provisions of this Constitution, it shall be the duty of a Commission to which this Part applies to appoint, confirm, emplace on the permanent or pensionable establishment, promote, transfer and exercise disciplinary control over members of the service or services to which its jurisdiction extends.

So there you are


I hasten to add that denying the state secretary to perform his duties and any amendment to the Selangor State Constitution in the matter is ultra vires the Federal Constitution by Articles 75 and 81

Article 75 Inconsistencies between Federal and State laws

If any State law is inconsistent with a federal law, the federal law shall prevail and the State law shall, to the extent of the inconsistency, be void.

Article 81 Obligation of States towards Federation

The executive authority of every State shall be so exercised—

(a) as to ensure compliance with any federal law applying to that State; and

(b) as not to impede or prejudice the exercise of the executive authority of the Federation

Tricia Yeoh will not comment but since my posit on the appointment is incontrovertible then it follows that

52 (1) There shall be constituted the offices of State Secretary, State Legal Adviser and State Financial Officer; and the appointments thereto shall be made by the appropriate Service Commission from amongst members of any of the relevant public services.

52 (5) The persons holding the office of the State Secretary, the State Legal Adviser and the State Financial Officer respectively immediately before the coming into operation of Clause (1) shall continue to hold that office in like manner as if he had been appointed under that Clause.

By not enforcing the Oath of Secrecy, Selangor State Constitution 52(4), upon the new state secretary, Tan Sri Khalid risks state "secrets" being exposed. 52(3) Every such official shall have the right to take part in the proceedings of the State Executive Council and the Legislative Assembly and may be appointed to any committee thereof, but shall not have any vote in the State Executive Council or the Legislative Assembly or any such committee.

Not voting is not a problem but he is not bound by any oath of secrecy!
